The new regulations define Authorized Representation to include distant sellers with respect to waste management obligations.
Who is in Scope?
This applies to any natural or legal person who, regardless of the method of sale — including sales via distance contracts — sells products directly to consumers or end-users in Türkiye.
Specifically, it covers producers located outside Türkiye who sell their products directly to Turkish consumers via remote communication channels.
Producers selling to Türkiye must appoint an Authorized Representative to ensure full compliance with waste management and product safety regulations.
An Authorized Representative is a natural or legal person residing in Türkiye, formally assigned by the manufacturer to fulfill certain regulatory obligations on their behalf, in accordance with relevant legislation.
Duties of the Authorized Representative
The Authorized Representative (AR) carries out the obligations delegated by the manufacturer in writing, specifying the nature, conditions, and limits of these powers and duties.
Key responsibilities include:
Document Retention: The AR keeps all documents required by technical regulations demonstrating product conformity for at least ten years from the date the product is placed on the market (or as specified in the relevant technical regulation). Documents must be provided in Turkish or in other languages accepted by the authorities upon request.
Regulatory Instructions: The AR promptly follows instructions from the authorized institution to eliminate product risks.
Environmental Registration & Reporting:
Register with the Ministry of Environment’s online system (WEEE, Battery, Packaging).
Report Put-On-Market and Collection volumes annually.
Financial Reporting & Fees:
Register with the Ministry of Finance’s online system.
Report distant sales amounts and pay the Recovery Participation Fee (GEKAP) quarterly.
The AR ensures that the manufacturer complies fully with Turkish regulations and acts as the primary point of contact for authorities.
